This website, www.finlabsindia.com, (hereinafter referred to as “Finlabs India”) is owned, hosted and operated by Finlabs India Pvt. Ltd. (hereinafter referred to as FIPL), a company incorporated in India under the Companies Act, 1956 and having its registered office at Office No. 66, 2nd Floor, Balkrishna Niwas, 2nd Panjrapole Lane, Near C P Tank Circle, Mumbai – 400004.
परिभाषाएँ
The term ‘authorised user’ includes any person, whether an individual or a legal entity, who has subscribed to the services of Finlabs India and whose access is restricted by a sign-in username and password. The username and password are either allotted by Finlabs India, or chosen by the user and agreed by Finlabs India. Only the authorised user has the right to access the services offered by Finlabs India.
For the purposes of this agreement, any person who does not have a legal or a contractual right to access the services, but does so, will fall within the definition of an ‘unauthorised user’ and will be subject to the terms and conditions, and expressly so with respect to respecting the intellectual property rights of the provider, and abiding by licensing terms and conditions.
The terms ‘User’ and ‘Customer’ include both authorised users and browsers/visitors.
The terms ‘service’ or ‘services’ would mean to include the interactive online tools, information & research offered by Finlabs India on the internet through which the user may access information carried by Finlabs India, input and process their customer data and disseminate processed reports to their customers. The terms would include to mean the various reporting, transaction and analytical tools through which the user can provide personalised financial planning & advice, transaction facilities and monitoring portal to their clients.

If you utilise Finlabs India in a manner inconsistent with these Terms and Conditions, FIPL may terminate your access, block your future access and/or seek such additional relief as the circumstances of your misuse may be deemed to be fit and proper.
भुगतान की शर्तें
Payments for the services offered by Finlabs India shall be on a 100% advance basis. Payment for a service, once subscribed to, is not refundable and any amount paid shall stand appropriated. Refunds, if any, will be at the sole discretion of Finlabs India Pvt. Ltd. FIPL offers no guarantees whatsoever for the accuracy or timeliness of refunds reaching the Customer's card or bank account. User acknowledges and agrees that FIPL, at its sole discretion and without prejudice to other rights and remedies that it may have under the applicable laws, shall be entitled to set off the amount paid or payable by a subscriber/user against any amount(s) payable by User to FIPL under any other agreement or commercial relationship towards other products/services. Finlabs India Pvt. Ltd. gives no guarantees of server uptime or applications working properly. All services are provided on a best-effort basis and liability is limited to refund of the amount only. Finlabs India Pvt. Ltd. undertakes no liability for free services. Finlabs India Pvt. Ltd. reserves the right to amend, alter or change all or any disclaimers or terms of agreements at any time without prior notice. All terms and disclaimers, whether specifically mentioned or not, shall be deemed to be included if any reference is made to them.
Finlabs India Pvt. Ltd. takes the maximum care possible to ensure that data relating to electronic transfer of money does not fall into the wrong hands. To complete online transactions involving payments, a user is directed to a payment gateway; Finlabs India Pvt. Ltd. does not store or keep credit card data. Since the transaction happens on a third-party network not controlled by Finlabs India Pvt. Ltd., once a card transaction has been completed at the payment gateway, the payment information is not accessible to anyone at Finlabs India Pvt. Ltd. This ensures maximum security.
उपयोगकर्ता के खाते से जुड़ी किसी जानकारी, और/या क्रेडिट कार्ड / डेबिट कार्ड से किए गए ऑनलाइन लेन-देन, उनकी सत्यापन प्रक्रिया व विवरण से संबंधित जानकारी के किसी भी प्रकटीकरण (अनजाने में या अन्यथा) से हुई किसी हानि या क्षति के लिए Finlabs India Pvt. Ltd. उत्तरदायी नहीं होगा; और न ही इस प्रकार प्रकट तथा उपयोग की गई किसी जानकारी में हुई किसी त्रुटि, चूक या अशुद्धि के लिए — चाहे वह किसी क़ानूनी प्रक्रिया के तहत हुई हो या नहीं।
असफल लेन-देन में धन-वापसी
Though FIPL's payment reconciliation team works 24 x 7, FIPL offers no guarantees whatsoever for the accuracy or timeliness of refunds reaching the Customer's card or bank account. This is because of the multiple organisations involved in processing online transactions, the limitations of current internet infrastructure, and the working days and holidays of financial institutions.

ग्राहक सहमत है कि सेवा से प्राप्त सारी जानकारी या सेवा में उसे अन्यथा उपलब्ध कराई गई जानकारी (“सामग्री”) को वह Finlabs India की स्वामित्व वाली सामग्री मानेगा। ग्राहक सहमत है कि सदस्यों के लिए आरक्षित सामग्री गोपनीय रखी जाएगी और उसे Finlabs India के व्यापार रहस्य के रूप में संरक्षित किया जाएगा। Finlabs India किसी भी सामग्री की सटीकता की गारंटी नहीं देता, न उसका समर्थन या सिफ़ारिश करता है, और ग्राहक ऐसी सामग्री का उपयोग अपने जोखिम पर करता है। ग्राहक सेवा में मौजूद सामग्री/शोध तक केवल प्रारंभिक जानकारी पाने के लिए पहुँच सकता है, जिसके बाद आगे की जाँच-परख की जा सके। ग्राहक जानकारी तक पहुँच और उसका उपयोग व्यक्तिगत तथा आंतरिक कामों तक सीमित रखेगा, और सेवा से प्राप्त साधनों, शोध व जानकारी का उपयोग आगे वितरण, प्रकाशन, सार्वजनिक प्रदर्शन या व्युत्पन्न कृतियाँ बनाने के लिए नहीं करेगा, न ही किसी तरह ऐसी गतिविधियों में सहायता करेगा। ग्राहक सेवा से प्राप्त या सेवा में उपलब्ध कराई गई किसी भी सामग्री का उपयोग या पुनरुत्पादन किसी अन्य सेवा या उपकरण के लिए या उसके संबंध में नहीं करेगा। इसके अलावा, ग्राहक कंपनी द्वारा दी गई सेवा का उपयोग किसी अन्य सेवा या उपकरण के लिए या उसके संबंध में किसी और तरीक़े से नहीं करेगा। इन शर्तों का उल्लंघन करने वाले ग्राहकों की — विशेषकर ऐसे ग्राहकों की, जो स्वचालित या मैन्युअल तरीक़े से सेवा का दुरुपयोग करते हुए या अत्यधिक खोज करते हैं — सदस्यता बिना सूचना तत्काल समाप्त की जा सकती है।
बौद्धिक संपदा अधिकार
Finlabs India पर दिखने वाले सभी लोगो, ब्रांड, ट्रेडमार्क और सर्विस मार्क (“चिह्न”) या तो FIPL और/या उसके सहयोगियों की संपत्ति हैं, या लाइसेंस के तहत इस्तेमाल किए जाते हैं। इनसे उत्पन्न सभी अधिकार, वैधानिक या अन्यथा, पूरी तरह FIPL / उसके सहयोगियों में निहित हैं। इस वेबसाइट तक पहुँच से आपको इन चिह्नों के इस्तेमाल का कोई लाइसेंस या अधिकार नहीं मिलता, इसलिए इन चिह्नों का किसी भी रूप या तरीक़े से उपयोग पूरी तरह वर्जित है। इसका उल्लंघन भारत के प्रचलित क़ानूनों के तहत अपराध होगा।
FIPL सभी के बौद्धिक संपदा अधिकारों का सम्मान करता है, और इस संबंध में भारत में लागू सभी क़ानूनों का पालन करता रहा है और करता रहेगा। FIPL अपनी पूरी क्षमता से उपयोगकर्ताओं तथा तीसरे पक्षों के बौद्धिक संपदा अधिकारों की रक्षा और सम्मान करेगा। यदि कोई उपयोगकर्ता Finlabs India को दूसरों के बौद्धिक संपदा अधिकारों के उल्लंघन का मंच बनाते पाया जाता है, तो FIPL बिना किसी सूचना के यह अनुबंध तत्काल समाप्त करने के लिए स्वतंत्र होगा।
प्रतिबंध / मनाही
आप यहाँ स्पष्ट रूप से सहमत होते हैं कि आप यह नहीं करेंगे:
- Access data not intended for you or log into a server or account that you are not authorised to access;
- Attempt to breach security or authentication measures without proper authorisation;
- Attempt to interfere with service to any user, host or network, including but not limited to by submitting a virus or Trojan horse to Finlabs India, overloading, flooding, mail bombing or crashing;
- Finlabs India में मौजूद किसी भी सामग्री की अनुमति के बिना नक़ल करना, बाँटना, डाउनलोड करना, प्रदर्शित करना, प्रस्तुत करना, पुनरुत्पादित करना, बदलना, संपादित करना, परिवर्तित करना, बेहतर दिखाना, प्रसारित करना या किसी भी तरह से छेड़छाड़ करना या अन्यथा उसका उपयोग करना;
- इस जानकारी की नक़ल कर उसे किसी अन्य सर्वर पर बाँटना, या इस वेबसाइट की जानकारी, पाठ, ग्राफ़िक्स, ध्वनि आदि को बदलकर किसी अन्य सिस्टम में दोबारा इस्तेमाल करना। वेबसाइट के किसी भी हिस्से की प्रतिलिपि व्यावसायिक लाभ के लिए न बेची जा सकती है, न बाँटी जा सकती है, और न ही उसे बदलकर किसी अन्य कृति, प्रकाशन या वेबसाइट में शामिल किया जा सकता है — चाहे वह छपे रूप में हो या इलेक्ट्रॉनिक, जिसमें किसी अन्य वेबसाइट पर डालना भी शामिल है; या
- हमारी स्पष्ट लिखित सहमति के बिना, Finlabs India से नक़ल की गई या छापी गई किसी सामग्री से, या Finlabs India की लिंक से, मूल सामग्री में मौजूद कोई कॉपीराइट, ट्रेडमार्क या अन्य बौद्धिक संपदा सूचना हटाना।
- The user shall not use the services offered by Finlabs India in any manner that impairs the interests and functioning of FIPL/Finlabs India. The user undertakes not to duplicate, download, publish, modify or distribute material on Finlabs India unless specifically authorised by FIPL. FIPL forbids copying or duplicating web pages or content, by automated or manual means, for a purpose that has not been authorised in writing, other than indexing by search engines and AI assistants.
- Users undertake that the services offered by Finlabs India shall not be used to upload, post, email, transmit or otherwise make available, directly or indirectly, unsolicited bulk or commercial email. FIPL reserves the right to filter, monitor and block emails sent by users through servers maintained by FIPL. FIPL and the user shall make all attempts to abide by international best practices in containing and eliminating spam.
Finlabs India या उससे जुड़ी साइटों के उपयोगकर्ता / सदस्य / आगंतुक को ऐसी कोई जानकारी अपलोड करने, पोस्ट करने, भेजने, अपडेट करने या साझा करने की मनाही है, जो:
- Belongs to another person and to which the user does not have any right;
- Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially or ethnically objectionable, disparaging, relating to or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
- Harms minors in any way;
- जो किसी पेटेंट, ट्रेडमार्क, कॉपीराइट या अन्य स्वामित्व अधिकारों का उल्लंघन करता हो;
- जो उस समय लागू किसी क़ानून का उल्लंघन करती हो;
- जो प्राप्तकर्ता को ऐसे संदेशों के स्रोत के बारे में धोखा दे या भ्रमित करे, या ऐसी जानकारी भेजे जो अत्यंत आपत्तिजनक या धमकी भरी हो;
- Impersonates another person;
- जिसमें सॉफ़्टवेयर वायरस या ऐसा कोई अन्य कंप्यूटर कोड, फ़ाइल या प्रोग्राम हो जो किसी कंप्यूटर संसाधन के काम में बाधा डालने, उसे नष्ट करने या सीमित करने के लिए बनाया गया हो;
- Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or insults any other nation.
सिस्टम या नेटवर्क सुरक्षा का उल्लंघन दीवानी या आपराधिक दायित्व ला सकता है।
तीसरे पक्ष की वेबसाइटों की लिंक
Finlabs India अन्य तीसरे पक्ष की वेबसाइटों या संसाधनों की लिंक दे सकता है। इस वेबसाइट (Finlabs India) के ज़रिए आप जिस किसी अन्य वेबसाइट तक पहुँचते हैं, उसके बारे में FIPL कोई दावा नहीं करता।

समाप्ति

Submissions and unauthorised use of any information(s)/materials contained on Finlabs India may violate copyright laws, trademark laws, the laws of privacy and publicity, certain communications statutes and regulations thereto and other applicable laws, statutes and its rules and regulations. You alone are responsible for your actions or the actions of any person using your user name and/or password.

Use of Finlabs India is subject to the Finlabs India गोपनीयता सूचना.
मध्यस्थता
वेबसाइट के उपयोग से या उसके बाद, इस अनुबंध के किसी प्रावधान की वैधता, व्याख्या, क्रियान्वयन या कथित उल्लंघन के संबंध में उपयोगकर्ता और FIPL के बीच कोई विवाद उठता है, तो वह विवाद एकमात्र मध्यस्थ को सौंपा जाएगा, जो FIPL द्वारा चुना गया एक स्वतंत्र और निष्पक्ष तीसरा पक्ष होगा। मध्यस्थ का निर्णय दोनों पक्षों पर अंतिम और बाध्यकारी होगा। मध्यस्थता का स्थान मुंबई होगा। मध्यस्थता कार्यवाही पर मध्यस्थता एवं सुलह अधिनियम, 1996 लागू होगा।
प्रावधानों की पृथक्करणीयता
आपके और FIPL के बीच यह अनुबंध Finlabs India के आपके उपयोग को नियंत्रित करता है। यदि इन वेबसाइट शर्तों का कोई प्रावधान या उसका कोई हिस्सा किसी सरकार के क़ानून, नियम, आदेश या विनियमन के विरुद्ध हो, या किसी अदालत के अंतिम निर्णय से अमान्य/शून्य ठहराया जाए, तो उस असंगति या अमान्यता से बाक़ी शर्तों की प्रवर्तनीयता पर कोई असर नहीं पड़ेगा।
अधिकार-त्याग
उपयोग की नियम-शर्तों के किसी अधिकार या प्रावधान को FIPL द्वारा लागू न करने का अर्थ यह नहीं कि उसने बाद में उसे लागू करने का अधिकार छोड़ दिया है।
लागू क़ानून
इस वेबसाइट तक पहुँचकर आप सहमत होते हैं कि Finlabs India से जुड़े सभी मामलों तथा इन नियम-शर्तों पर भारत में प्रचलित क़ानून ही लागू होंगे।
क्षेत्राधिकार
Finlabs India से जुड़े सभी मामलों तथा इन नियम-शर्तों पर केवल मुंबई, भारत की अदालतों का ही विशेष क्षेत्राधिकार होगा — चाहे आप Finlabs India को किसी भी क्षेत्र या अधिकार-क्षेत्र से देख रहे हों।
FIPL आमतौर पर वेबसाइट पर आपकी पोस्ट की निगरानी नहीं करता, पर ऐसा करने का अधिकार सुरक्षित रखता है। फिर भी, यदि FIPL को Finlabs India या उसकी किसी सेवा के अनुचित उपयोग का पता चलता है, तो वह अपने विवेक से जो उचित समझे, वैसी प्रतिक्रिया देगा। आप स्वीकार करते हैं कि FIPL को ऐसे किसी भी कार्य की, जो अवैध माना जा सकता है, तथा ऐसे अवैध आचरण की मिली किसी भी जानकारी की सूचना क़ानून प्रवर्तन अधिकारियों को देने का अधिकार होगा। अनुरोध किए जाने पर, FIPL इंटरनेट पर कथित अवैध गतिविधि की किसी भी जाँच में क़ानून प्रवर्तन एजेंसियों के साथ पूरा सहयोग करेगा।
FIPL अन्य सभी अधिकार सुरक्षित रखता है।
